11. Arbitration Agreement & Class Action Waiver

11.2 Governing Law

This agreement is governed by the Federal Arbitration Act and the laws of the State of California.

11.3 Arbitration Rules

Arbitration will be administered by the American Arbitration Association (AAA) under its applicable rules.

11.4 Class Action Waiver

You and the Company agree that claims may only be brought in an individual capacity, not as part of a class or representative action.

11.5 Exceptions

Either party may bring claims in small claims court where appropriate.

11.6 Severability

If any part of this arbitration provision is unenforceable, the remainder will still apply.

12. General Provisions

Entire Agreement. These Terms constitute the entire agreement regarding use of the Site.
 

Governing Law and Venue. Except as otherwise provided in the arbitration section, these Terms are governed by California law. Venue for permitted court actions shall be in California.

Attorneys’ Fees. The prevailing party in any permitted legal action may recover reasonable attorneys’ fees.

Severability. If any provision is held invalid, the remainder remains in effect.

Termination. We may suspend or terminate your access to the Site at any time without notice.

Survival. Provisions that by their nature or wording should survive termination will survive.
